TERMS AND CONDITIONS OF USE AND SALE – ROCKPORT PORTUGAL
PREAMBLE
Iconic Brands, Lda., legal entity no. 518 835 715, headquartered at Avenida Paul Harris, nº1, Edifício D 2710-724 Mem Martins, Sintra Portugal, hereinafter "Rockport," operates the website www.rockport.pt (hereinafter "Rockport Site" or "Site") as a licensee of the Rockport brand, under the agreement made with ABG-Rockport LLC.
This document regulates the terms and conditions applicable to the use of the Site and purchases made thereon.
The use of the Site implies full acceptance of these Terms and Conditions. These can be saved, printed, or consulted at any time through the Site.
CHAPTER I – GENERAL TERMS OF USE OF THE SITE
Article 1 – Object
This document establishes the terms that govern the use of the Rockport Site by users, as well as the rules applicable to online purchases.
The acceptance of these Terms and Conditions is a necessary condition for using the Site and making purchases.
Article 2 – Users, Registration and Accuracy of Information
1. Making purchases requires prior registration as a User.
2. Only individuals aged 18 or over may register.
3. The User guarantees that the information provided is truthful, complete, and up-to-date.
4. Rockport reserves the right to suspend accounts in the event of signs of fraudulent use.
Article 3 – Rockport Newsletter
The User can voluntarily subscribe to the newsletter and unsubscribe at any time through the link provided in each communication.
Article 4 – Intellectual Property
All visual, textual, and technological elements present on the Site are the property of Rockport or third parties duly authorized. Reproduction, modification, or use without prior authorization is prohibited.
Article 5 – Products
Rockport provides clear and updated information about the items sold, namely footwear and accessories, ensuring the best possible representation through descriptions and images.
Article 6 – Payments
Rockport offers the following payment methods:
- Credit Card (Visa, Mastercard);
- MBWay;
- Klarna;
- Multibanco (Payment for Services).
Payments are processed securely, and Rockport does not have access to users' complete banking data.
Article 7 – Responsibility
Rockport makes its best efforts to ensure the proper functioning of the Site. However, it is not responsible for interruptions, technical failures, or internet viruses, nor for force majeure situations.
Article 8 – Privacy and Data Protection
The processing of personal data complies with the GDPR and the principles defined in the Privacy Policy available on the Site. The User may exercise their rights of access, rectification, opposition, and deletion by sending a request to Rockport's official email.
CHAPTER II – SALES CONDITIONS ON THE ROCKPORT SITE
Article 9 – Ordering Process
To make purchases, the User must:
1. Select the desired product(s);
2. Confirm the cart;
3. Enter delivery details;
4. Choose the payment method;
5. Confirm the order.
The final confirmation amounts to the conclusion of the purchase and sale contract.
Article 10 – Stock Availability
The sale is subject to stock availability. In case of a stock rupture, the User will be informed and reimbursed within a maximum period of 14 days.
Article 11 – Delivery
1. Deliveries are made to mainland Portugal, Autonomous Regions, Spain, and other countries indicated at checkout.
2. Delivery costs and deadlines are presented at the time of purchase.
3. Rockport commits to deliver within the maximum legal period of 30 days unless a different agreement is made.
4. Responsibility for delays attributable to the user, the carrier, a third party, or force majeure does not lie with Rockport.
Article 12 – Prices
The prices include VAT at the legal rate. Shipping costs are not included in the product price and are presented at checkout.
Article 13 – Right of Withdrawal, Returns, Exchanges, and Guarantees
1. The User has a period of 14 days to exercise the right of withdrawal, without the need to state a reason. For this purpose, consult the information contained in the Withdrawal Information Form published on this site.
2. Returns must meet the following conditions:
o Unused product;
o Original packaging and labels intact;
o No signs of use.
3. Return costs are borne by the User, except in the case of a logistical error by Rockport.
4. Rockport does not accept cash on delivery returns.
5. Legal guarantees are the ones applicable under Decree-Law no. 84/2021.
Article 14 – Failure to Claim or Pick Up
In case of return to the sender due to inability to deliver attributable to the User, there may be additional reshipping costs.
CHAPTER III – FINAL PROVISIONS
Article 15 – Changes to Terms and Conditions
Rockport may change these Terms and Conditions at any time. Continued use of the Site implies acceptance of the changes.
Article 16 – Proof and Archiving
The electronic records kept by Rockport constitute proof of transactions.
Article 17 – Applicable Law and Forum
These Terms and Conditions are governed by Portuguese law. In case of dispute, the court in the consumer's place of residence shall have jurisdiction.
Article 18 – Alternative Dispute Resolution
In case of consumer disputes, the consumer can resort to the competent Alternative Dispute Resolution entity: Lisbon Consumer Disputes Arbitration Centre (CACCL), with the site www.centroarbitragemlisboa.pt. Rockport is not bound to alternative dispute resolution before this or any other ADR entity.
